If you do not agree to be bound by these Terms or any updates or modifications to these Terms, you may not access or use The Hump Services. WE DO NOT PROVIDE INVESTMENT OR FINANCIAL ADVICE OR CONSULTING SERVICES. WE ARE ONLY THE PROVIDER OF THE HUMP WALLET, AND WE DO NOT ADVISE OR MAKE RECOMMENDATIONS ABOUT ENGAGING IN CRYPTO ASSET TRANSACTIONS OR OPERATIONS. DECISIONS TO ENGAGE IN TRANSACTIONS OR PERFORM OPERATIONS INVOLVING CRYPTO ASSETS SHOULD BE MADE AT YOUR OWN DISCRETION.

APRIVACY POLICY: For an explanation of how we collect, use, and disclose information from our users, please see our Privacy Policy at https://thehump.website/privacy-policy. You acknowledge and agree that your use of The Hump Services is subject to our Privacy Policy and that we may collect, use, and/or disclose your information (including any personal data you provide to us) in accordance with our Privacy Policy.

UPDATES TO TERMS OR SERVICES: We reserve the right to update or modify these Terms at any time, at our sole discretion. If we do so, we will notify you by either posting the revised Terms on our website, in our mobile application, or through other reasonable methods of communication. Such revised Terms will take effect immediately, unless otherwise indicated. You should regularly check our website to inform yourself of any changes and decide whether or not to accept the updated version of these Terms. If you continue to use The Hump following any update or modification of the Terms, you will be deemed to have accepted the updated Terms. If you do not agree to the Terms or any update or modification to the Terms, you must cease accessing or using The Hump Services. Our services evolve over time. We may change or discontinue all or any part of The Hump Services at any time and without prior notice, at our sole discretion.

ELIGIBILITY To be eligible to use The Hump wallet: (i) you must be at least eighteen (18) years old and legally competent to enter into these Terms; (ii) you must not be a resident of sanctioned jurisdictions according to any trade embargoes, UN Security Council Resolutions (“UNSCR”) or HM Treasury's financial sanctions regime; and (iii) you must not be currently the subject of or subject to economic sanctions such as the United Nations Security Council Sanctions List, the list of specially designated nationals maintained by OFAC, or any other sanctions list maintained by any relevant sanction authority. If you are accessing our Services on behalf of a legal entity, you further represent and warrant that: (iv) the legal entity is duly organized and validly existing under the applicable laws of the jurisdiction of its organization; and (v) you are duly authorized by such legal entity to act on its behalf. You can only use our Services if permitted by the laws of your jurisdiction. For the avoidance of doubt, you may not use our Services if you are located in, or a citizen or resident of any state, country, territory or other jurisdiction where your use of our Services would be illegal or otherwise violate any applicable laws. Please make sure that these Terms are in compliance with all laws, rules, and regulations that apply to you. You agree that you are only using our Services with legally-obtained funds that rightfully belong to you. By using The Hump wallet, you represent and warrant that you meet all eligibility requirements that we outline in these Terms. We may still refuse to let certain people access or use The Hump wallet, however, and we reserve the right to change our eligibility criteria at any time.

SERVICES The Hump wallet is a non-custodial wallet software, for digital assets such as cryptocurrencies, virtual commodities and NFTs (“Digital Assets”), meaning you are solely in control of and responsible for your Digital Assets and private keys, and accordingly you can authorize transactions from your wallet address. The Hump wallet is non-custodial wallet software, so you are solely responsible for your activity and any risk of loss at all times.

The Hump wallet allows you to: Generate wallet addresses and associated private keys that you may use to send and receive digital assets; browse and access third party decentralized application(s) (“DApp(s)”) and third party decentralized exchanges (“DEX”) through the mobile application’s web browser; swap/trade digital assets through DApp functionality made available by third party service provider(s); stake certain digital assets in a third party ‘proof of stake’ network through staking services (“Staking Service”); view digital asset price information made available by third party service provider(s); and broadcast Digital Asset Transaction data to various blockchains supported by The Hump wallet without requiring you to download or install the associated blockchain-based software to your local device.

Use of "The Hump" Wallet App When using the "The Hump" Wallet app, you are solely responsible for the safekeeping of your wallet address, private key, and backup information such as your Secret Phrase. It is imperative to backup these elements to avoid losing control of your digital assets. "The Hump" does not store or receive your password, private key, or Secret Phrase and cannot generate a new password for you if you forget your original one. If you do not safely archive your wallet information, any digital assets associated with that wallet may become inaccessible. "The Hump" shall not be responsible or liable in such cases.

Using DApps and DEX with "The Hump" When accessing or using DApps or DEX through "The Hump", you acknowledge and agree that "The Hump" is not responsible for your use of these services and has no liability in connection with any transactions or issues that may arise. The limitations and fees associated with DEX transactions are subject to the requirements of third-party developed Smart Contracts and may vary. You are solely responsible for the consequences of any transactions made through DApps or DEX, including incorrect transfers or issues with node servers. "The Hump" does not guarantee the accuracy or appropriateness of any fees displayed in connection with DApps or DEX, and may charge its own fees for use of these services in the future. Any updated fees will apply to transactions made after the effective date of the change.

Use of The Hump Staking Service When you use The Hump Staking Service, a third party may hold certain Digital Assets on your behalf (“Staked Digital Assets”), serving as a transaction validator on the relevant blockchain network. If a block of transactions is validated using the staked Digital Assets, a reward is granted by the network (“Staking Reward”). Please note that The Hump is not responsible for: (i) your use of the Staking Service and will have no liability in connection with your use of it; (ii) ensuring Staking will happen continuously; and (iii) ensuring any particular Digital Asset will be staked or will continue to be staked.

Purchasing Digital Assets with Supported Credit or Debit Cards When you use The Hump to purchase Digital Assets with your credit or debit card, a third party will convert your selected amount into the desired Digital Asset and credit it to your wallet. Please note that: (i) The Hump is not responsible for your use of the third-party service and will have no liability in connection with your use of it; (ii) you will be subject to the terms and conditions imposed by the relevant third-party service provider; (iii) The Hump has no ability to modify, withdraw or cancel any conversion requests you make; (iv) The Hump is not responsible for any exchange rates offered by the relevant third-party service provider(s); and (v) The Hump is not responsible for any fees charged by the relevant third-party service provider(s) or your bank or credit card issuer(s).

Digital Asset Transactions For all proposed Digital Asset transactions to be completed, they must be confirmed and recorded on the Digital Asset’s public blockchain. These networks are decentralized, peer-to-peer networks supported by independent third parties, which The Hump does not own, control, or operate. The Hump has no control over the blockchain networks and cannot ensure that any transaction details you submit through our Services will be confirmed and processed. By using The Hump, you acknowledge and agree that: (i) The Hump does not have the ability to cancel or modify your transaction; (ii) the transaction details you submit may not be completed or may be substantially delayed by the relevant blockchain networks; (iii) The Hump does not store, send or receive Digital Assets; and (iv) any transfer of Digital Assets occurs on the relevant blockchain network and not on a network owned by The Hump and therefore The Hump does not guarantee the transfer of title or rights in any Digital Asset.

Accuracy of User-Provided Information: You declare and warrant that any information you provide through the Services is accurate and complete. You accept and acknowledge that The Hump is not responsible for any errors or omissions you make in connection with any Digital Asset transaction initiated through the Services. The Hump strongly encourages you to carefully review your transaction details before attempting to transfer a Digital Asset.

"The Hump" Crypto Wallet Registration and Security In order to use "The Hump" crypto wallet, you must either import an existing wallet or create a new one. Upon creating a wallet, you will be assigned a private key. You agree to immediately notify us of any unauthorized use of your private key or any other security breach related to your wallet. You acknowledge and accept that you will be solely responsible for maintaining the confidentiality and security of your private key. You will also assume all risks associated with the use of the wallet.

For maximum security, we recommend taking the following precautions: (a) create a strong and unique password that is not used for any other purpose and utilize biometric authentication if available, (b) do not store the private key and secret phrase in plain text online or in an insecure physical location, (c) limit access to your devices and wallet, (d) take all necessary measures against malware on your devices and networks, and (e) promptly notify us of any suspected security breaches. We will not be held liable for any unauthorized activities in your wallet.

Push Notifications: You have the option to receive push notifications from "The Hump" wallet, which will alert you to congested blockchain networks and completed transactions involving your wallet. To opt-in to this service, simply go to the "Settings" section and enable "Push Notifications."

Payment and Fees: Any fees associated with the use of "The Hump" wallet or its components will be clearly stated on the wallet's website and/or mobile application.

Transaction Fees Transaction fees, such as mining fees, may be required by the virtual currency system or blockchain network you are using. Before initiating a transaction, make sure you have enough funds in your wallet and/or gas to cover these fees. We will not be held responsible for failed transactions or losses due to incorrect transaction fees, insufficient funds, or gas. We do not have access to your or anyone else's transactions.

Taxes: It is your responsibility to determine and report any taxes that may apply to your transactions made through "The Hump" wallet. We are not responsible for determining taxes, collecting, reporting, withholding, or remitting any taxes related to digital asset transactions.

Third-Party Services and Content Any references or descriptions of third-party products or services (including through hyperlinks) do not constitute endorsement or promotion by us. We reserve the right to modify or cancel the availability of any third-party service. You have the option to receive push notifications from third-party content providers, but you must opt-in to receive them. We do not endorse or control any third-party content shared through push notifications and will not be responsible for their availability or sales. If you grant permission to a third party to access your "The Hump" wallet, either directly or through the wallet, you acknowledge that you will remain responsible for their actions and any responsibilities under these terms.

Intellectual Property License By agreeing to these terms, we grant you a non-exclusive, non-sublicensable, and non-transferable license to use "The Hump" wallet for personal or internal business use only. You may not (a) reproduce, modify, or create derivative works of any part of the wallet, (b) rent, lease, distribute, sell, sublicense, transfer, or provide access to the wallet, (c) use the wallet for the benefit of a third party, (d) incorporate the wallet into a product or service provided to a third party without our prior written consent, (d) circumvent any security measures in the wallet, (f) reverse engineer, disassemble, decompile, translate, or attempt to obtain the source

THE HUMP LICENSE TO NFT CONTENT

By storing your non-fungible tokens (NFTs) on The Hump, you represent and warrant that you own all legal rights, title, and interest in the content associated with the NFT (NFT Content), or you are legally authorized by the owner of the intellectual property rights in the NFT Content to store the NFTs on The Hump. You retain all rights to the NFT Content stored on The Hump, except for the rights expressly granted here. By using The Hump, you grant us a license to access, use, host, cache, store, copy, reproduce, transmit, display, publish, distribute, adapt, and modify (for technical purposes, e.g., ensuring the content is viewable on various devices) the NFT Content in any and all media and distribution methods, currently known or developed in the future, solely for the purpose of operating and providing The Hump services. We do not monitor the NFTs and NFT Content hosted on The Hump for any infringement of a third party’s intellectual property rights. As a result, we assume no liability for any action regarding the NFT Content provided by you. You acknowledge that it is your sole responsibility to conduct all necessary due diligence for your activities related to NFTs and represent and warrant that you have not relied on, and shall have no remedies in respect of, any statement or representation made by us in relation to any transfer or interaction with any NFTs. If you have a dispute in relation to the NFTs and/or NFT Content, you release us from any claims, demands, and damages of every kind, known or unknown, arising from such disputes. By entering into this release, you waive any protections that would limit the coverage of this release to claims you know are in your favor.

YOUR USE OF THE HUMP You consent not to infringe any laws when utilizing our services,services. This includes provincial, state, federal, national, or international laws that apply to you. You also agree not to use our services for any illegal activities. This includeslimited to illegal or otherwise prohibited trade, illegal gambling, fraud, money laundering, or terrorist activities. If we discover that you have violated these terms and/or applicable laws or regulations, we reserve all rights and remedies under these terms and the law and wlaw. Wee necessary actions against you. Furthermore, you agree that: (i) you will not encourage or induce any third party to engage in any activities prohibited under these terms; (ii) you will not impersonate someone or use or attempt to use another user’s wallet without authorization, or use our services in a manner that interferes with or negatively affects other users; (iii) you will not distribute any harmful computer code through The Hump; (iv) you will not take any action that imposes an unreasonable load on our or any third-party provider’s infrastructure; (v) you will not reverse engineer, bypass, or attempt to bypass any measures we use to prevent or restrict access to our services, including but not limited to other accounts, computer systems, or networks connected to our services; and (vi) you will not violate, misappropriate, or infringe on the rights of The Hump, our users, or others, including privacy, publicity, intellectual property, or other proprietary rights. Although we have no obligation to monitor user content, we reserve the right to take necessary actions at any time and for any reason without notice if you breach these terms. Any use of The Hump other than as specifically authorized in these terms, without our prior written permission, is strictly prohibited and we reserve the right to immediately terminate

Disclaimer of Warranties and Limitation of Liability for The Hump Wallet

By using The Hump Wallet, you acknowledge and agree that we have no control or responsibility for:

Failures, disruptions, errors, or delays in the processing of digital assets

Risks associated with hardware, software, and internet connections

Risks of malicious software being introduced in the software underlying The Hump Wallet

Risks of unauthorized access to information stored in your wallet, such as your wallet address, private key, and Secret Phrase

Risks of unknown vulnerabilities or changes in the applicable blockchain networks

Therefore, you release us from all liability related to losses, damages, or claims arising from:

User error, such as forgotten passwords, incorrect transactions, or mistyped digital asset addresses

Server failure or data loss

Unauthorized access to The Hump Wallet application

Bugs or other errors in the software

Any unauthorized third-party activities, including viruses, phishing, and brute force attacks against The Hump Wallet

The Hump Wallet makes no representations about any third-party content available through our services. Any terms, conditions, warranties, or representations related to such content are solely between you and the respective organizations and individuals.

Limitation of Liability: To the fullest extent permitted by law, we, our affiliates, and our respective shareholders, members, directors, officers, employees, agents, representatives, suppliers, or contractors will not be liable for any direct or indirect damages, including but not limited to:

Loss of data, information, revenue, profits, or other business benefits

Any unauthorized use of your wallet address and private key due to your failure to maintain confidentiality

Interruptions or cessation of transmission to or from our services

Bugs, viruses, or other malicious software found in The Hump Wallet software or transmitted through our services by a third party

Actions taken or not taken as a result of communications from you

Human errors, technical malfunctions, failures, or omissions

Equipment damage or injury

Inability to access our website, The Hump Wallet or other websites

Theft, tampering, destruction, or unauthorized access to images or other content

Data processed late, incorrectly, incompletely, or lost

Typographic, printing, or other errors

In no event shall our liability to you for all damages exceed the amount of one hundred US dollars ($100.00 USD) or its equivalent in the local currency of the jurisdiction. Note that some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages.

To the maximum extent permitted by law, we disclaim all express or implied representations and warranties relating to the services and underlying software or any aspect of the information, content, or services. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, title, non-infringement, freedom from computer viruses, and any implied warranties arising from the course of dealing, course of performance, or usage in trade. We do not represent or warrant that the content accessible via the services is accurate, complete, available, current, or free of viruses or other harmful components. We also do not guarantee that the results of using the services will meet your requirements. There is no guarantee or warranty that access to "The Hump" or its functionality will be uninterrupted, timely, or error-free. Some states do not allow the disclaimer of implied warranties, so the above disclaimers may not apply to you.

Indemnification. You agree to defend, indemnify, and hold harmless us, our affiliates, and our respective shareholders, members, directors, officers, employees, attorneys, agents, representatives, suppliers, and contractors from and against any claims, damages, losses, liabilities, and expenses arising from your use of and access to the services, any feedback or submissions you provide to us concerning "The Hump", your violation of any third-party content, your violation of the terms, or your violation of any law, rule, or regulation.

Time Limitation on Claims: You agree that any claim you may have arising from or related to your relationship with us must be filed within one year. If you file your claim later, your claim is permanently barred.

Governing Law: The laws of the State of California will govern these terms and the parties' relationship as if you signed these terms in California. This is without regard to California's conflict of laws rules. If any provisions of these terms are inconsistent with any applicable law, those provisions will be superseded or modified only to the extent necessary. The parties agree to submit to the federal or state courts in California for exclusive jurisdiction of any dispute arising from or related to your use of the services or your breach of these terms. You waive any objections based on lack of personal jurisdiction, place of residence, improper venue, or forum non conveniens in any such action.

Note to International Users: If you are a user accessing or using our services from a region with laws or regulations governing personal data collection, use, and disclosure that differ from United States laws, please note that we do not collect or process your personal data, except as provided for in our Privacy Policy.

Termination In the event of termination of your license to use "The Hump", your obligations under this agreement will continue. Your access to the funds in your wallet after termination will depend on your access to your backup of your wallet address and private key.

Discontinuation of Services for "The Hump" Wallet We reserve the right, at our sole discretion, to modify or discontinue any part of our services, without prior notice and at any time, temporarily or permanently. It is your responsibility to store a backup of your wallet address and private key pair outside of our services to access the blockchain network where your wallet is secured. This backup will allow you to fully restore your wallet and access your digital assets at any time, without cost or loss. If you do not have an external backup, you will not be able to access your digital assets. Trust Wallet is not responsible or liable for any loss of digital assets in the event of discontinuation of our services.

No Waiver Our failure to exercise or delay in exercising any right or privilege under this agreement will not be considered a waiver, and any partial exercise will not prevent any other or further exercise. The waiver of any right or provision must be in writing and signed by an authorized representative of us. The exercise of remedies by either party will not affect other remedies available under this agreement or otherwise.

Severability In the event that any part of this agreement is invalid, void, or unenforceable, it will be limited or eliminated to the minimum extent necessary. The limitation or elimination of this term will not affect the validity or enforceability of any remaining terms, clauses, or provisions.

Arbitration and Waiver of Class Action Both parties agree to resolve disputes arising from this agreement or use of our services through individual arbitration. The arbitration will occur in San Francisco, California and will be conducted confidentially by a single arbitrator, following the rules of the American Arbitration Association for consumer-related disputes. The arbitration will be conducted in English and with limited discovery. You may request in-person or telephone hearings, and the arbitrator may allow motions to be determined on briefs without oral hearings. The arbitrator has the authority to grant any remedy available to a court or tribunal, except for class procedures and remedies. The prevailing party in any enforcement action will be entitled to costs and attorney's fees. The arbitral decision may be enforced in any court. You and Trust Wallet agree to not bring a class action, class arbitration, or representative action against the other.

Force Majeure We will not be held liable for delays, failures, or interruptions of service resulting from events beyond our control, including but not limited to acts of God, civil or military authorities, terrorism, civil or industrial disturbances, blockages, embargoes, war, strikes, fire, earthquakes, storms, hardware or software failures, smart contract bugs, technological changes, changes in monetary conditions, changes to blockchain-related protocols, and other catastrophic events. If we are unable to provide our services due to events beyond our control, including but not limited to force majeure events or changes in laws and sanctions policies, we will not be liable for the services during that time.

Assignment We have the right to assign our rights and delegate our obligations under these terms without notice or consent from you. These terms will be binding on and inure to the benefit of both parties, their successors, and permitted assigns. Your agreement to these terms is personal and may not be transferred or assigned to a third party.

No Third-Party Beneficiaries There will be no third-party beneficiaries to these terms, except as expressly provided.

Entire Agreement This agreement constitutes the entire understanding and agreement between us, and supersedes any prior discussions, agreements, and understandings. Any modifications to these terms must be in writing and signed by both parties.

NOTICES FOR "THE HUMP" WALLET Any notifications or other forms of communication from us regarding these Terms, including changes to them, will be provided through the Services and/or other electronic means. By using the Services and having an account with us, you agree and give your consent to receive all communications, agreements, documents, notices, and disclosures electronically.
